Sayenko Kharenko wins multi-contract GAFTA arbitration case
Sayenko Kharenko international arbitration team successfully represented Ukrainian grain trader KAIC in an arbitral proceeding before The Grain and Feed Trade Association (GAFTA).
The arbitral proceeding, initiated by a Swiss grain trader, concerned damages compensation for alleged breach of three grain sale contracts for total amount of about USD 1 million, and counterclaim, filed by JSC KAIC on collecting a fine for delay in payment.
GAFTA arbitral tribunal agreed to arguments of Sayenko Kharenko team and declined the claim. At the same time, it satisfied a counterclaim by KAIC. The Arbitral tribunal found, that a Swiss trader committed a breach of contracts by unlawfully declaring their termination.
Sayenko Kharenko’s team included lawyers Tetyana Makukha and Olesia Gontar and was led by arbitration practice co-head Olena Perepelynska.
