Sayenko Kharenko represented German cosmetics company in multijurisdictional trademark dispute

Sayenko Kharenko’s IP team advised LR Health & Beauty Systems in Ukraine in connection with a pan-European trademark dispute. The part of the trademark dispute in Ukraine was related to the legal claim on the client’s international trademark registration invalidation in Ukraine due to its alleged non-use within three years. The court agreed with Sayenko Kharenko’s attorneys on the point that the fact that client used the trademark in new style does not change the distinctive aspect of the client’s registered trademark and decided in favor of the Sayenko Kharenko’s client.
