Sayenko Kharenko – legal counsel on obtaining merger clearance for acquisition of a producer of injection molding equipment
Sayenko Kharenko antitrust team has provided legal assistance in merger clearance with the Antimonopoly Committee of Ukraine (the "AMC") for the acquisition of Kunststofftechnik Waidhofen an der Thaya Gesellschaft m.b.H. ("KTW"), a manufacturer of injection molding equipment, by Husky Injection Molding Systems Ltd. ("Husky"), an Austrian-based manufacturer (with subsidiaries in Germany and the Czech Republic) of injection molding equipment.
The proposed acquisition allows Husky to integrate KTW’s closure molds into their injection molding systems. With the addition of KTW molds, Husky will be able to provide complete injection molding systems for closures (based on in-house components), including mold, machine, hot runner, temperature controller, etc.
After examining the proposed transaction, the AMC has concluded that its implementation poses no threat to competition nor significantly limits competition on any product market in Ukraine.
