Sayenko Kharenko represented OTP Bank in USD 16 mln debt collection

Sayenko Kharenko successfully represented PJSC "OTP Bank" (the "Client"), one of the largest banks with foreign capital in Ukraine, in court proceedings against a group of borrowers  – "Orient Express" LLC and "Hekra Pet Ltd" LLC – (the "Debtors") concerning debt collection under the loan agreement through repossession of collateral for the total amount of more than USD 16 mln.

Apart from handling the case in court, the litigation team of Sayenko Kharenko has developed an efficient strategy to protect the Client's rights and mitigate potential negative consequences of the Debtors' efforts to create legal and procedural hurdles in collection of debt.

The litigation team of Sayenko Kharenko represented the Client in the court of appeal. The judgement of the Economic Court of Kyiv, favourable to the Client, was upheld by the Kyiv Economic Court of Appeal.

Sayenko Kharenko's team was led by partner Sergey Pogrebnoy and included senior associates Anton Zhdanov and Petro Batiuk and associate Oleksiy Gerasymchuk.

Sayenko Kharenko's dispute resolution team regularly handles the largest litigations and arbitrations in Ukraine.
