Tatyana Slipachuk spoke at Swedish Arbitration Days

On 13-14 September Swedish Arbitration Days "The Challenge of Taking Evidence in International Arbitration" took place in Stockholm.

The event gathered the prominent international arbitration specialists and practitioners from all over the world, among whom should be named Sophie Lamb (Debevoise & Plimpton LLP, the UK), Alexis Mourre (Castaldi Mourre & Partners, France), Nathalie Voser (Schellenberg Wittmer, Switzerland), Vladimir Khvalei (Baker & McKenzi, Russia), Jason Fry (Clifford Chance, France), Tatyana Slipachuk (Sayenko Kharenko, Ukraine), and others.

This year Swedish Arbitration Days gathered around 300 participants including advocates, scholars and representatives of the arbitral institutions.

The list of the topics discussed actually has covered all the essential issues arising out of the taking of evidence in international arbitration, including: theories, rules, burdens of proof and thresholds of evidence; admissibility and weighing of evidence, adverse  inferences; presentation of evidence; documentary and electronic evidence; production of documents; witnesses of fact; expert evidence.

Dr. Tatyana Slipachuk, partner with Sayenko Kharenko, reported on the matters connected with the requests for production of documents, including application of IBA Rules on taking Evidence in International Arbitration and the differences which may arise because of different legal backgrounds and cultures of the parties and the members of the arbitral tribunals.
