The Cabinet of Ministers of Ukraine has prolonged the Resolutions adopted in 2015 that impose restrictions on the importation of goods originating from the russian federation

Despite the force of Resolution of the Cabinet of Ministers of Ukraine of 7 April 2022 426 “On the application of prohibitions on imports of goods from Russian Federation” (“Resolution 426”) that imposed a total embargo on the importation of products from the russian federation, the Cabinet of Ministers of Ukraine also prolonged its resolutions dated from 2015 that imposed partial restrictions on the importation of russian goods.

First, on 27 December 2022, Resolution of the Cabinet of Ministers of Ukraine 1450 “On amendments to the Resolution of the Cabinet of Ministers of Ukraine of 30 December 2015 1146 (“Resolution 1450”) was adopted that prolonged the Resolution of the Cabinet of Ministers of Ukraine of 30 December 2015 1146 (“Resolution 1146”).

Resolution № 1146 introduced the application of import duty rates, laid down by the Customs Tariff of Ukraine, concerning goods originating from the russian federation in response to a significant breach of the Free Trade Agreement by the russian federation. The purpose of adopting Resolution № 1146 was defined as the protection of Ukraine’s national economic interests and safety, restoration of violated rights, freedoms and lawful interests of Ukrainian citizens, society and the state caused by the actions of the aggressor state.

Resolution № 1450 prolonged the application of import duty rates for one more year – until 31 December 2023.

Second, Resolution of the Cabinet of Ministers of Ukraine of 27 December 2022 № 1448 “On amendments to the Resolution of the Cabinet of Ministers of Ukraine of 30 December 2015 1147” (“Resolution 1448”) prolonged the prohibition of importation in the customs territory of Ukraine of certain goods originating from the russian federation according to the compiled list. The corresponding list was adopted on 30 December 2015 in response to the enactment by the government of the russian federation of a decision concerning the prohibition of importation in the customs territory of the russian federation of agricultural products originating from Ukraine. Also, Resolution № 1448 prolonged for a year the prohibition of importation in the customs territory of Ukraine under the customs regime of import and the customs regime of temporary importation with conditional partial exemption from taxation by customs payments of carriages (UCGFEA 8606 30 00 00, 8606 91 80 00, 8606 92 00 00), which have been registered/listed by residents of the russian federation since 20 February 2014.
